Republic Petroleum LLC v. Dynamic Offshore Resources NS LLC, 2015 Tex. App. LEXIS 9055 (Tex.App. Houston [1st Dist], 2015)
Suit brought the operator of an offshore well, Republic, to recover damages. Dynamic defended and argued that, since Republic has transferred its entire interest to related parties, and the third-parties were not parties to the suit, it had no standing. The court held that, under the terms of the operating agreement, which provided that Republic was authorized to act on behalf of the non-operators, it had standing to pursue the claims on their behalf.
